Definitions

  1. In these Terms and Conditions:

    1. “Program” means the Armadale Garage Sale;

    2. “CoA” means the City of Armadale (ABN 79 863 269 538) of 7 Orchard Avenue, Armadale;

    3. “Website” mean the City of Armadale website: https://www.armadale.wa.gov.au

General

  1. The Program is open to Australian residents that resides within CoA.

  2. Instructions on how to participate form part of these terms and conditions.

  3. By participating, residents agree to abide by these Terms and Conditions.

Who Can Participate?

  1. Participation is open to residents of Australia that are 18 years of age or older, and reside within CoA.

  2. Applications can only be for residential properties.

  3. At its sole discretion the CoA reserves the right to:

    1. verify the validity of participants (including participants identity, eligibility, age and place of residence);

    2. disqualify any participants for tampering with the process or for submitting an application not in accordance with these Terms and Conditions; and

    3. remove and exclude any participants that does not meet the eligibility requirements set out in these Terms and Conditions from the Program at any time.

  4. A participant can only submit one application per residence per sale day.

  5. This Program is not for commercial use. A commercial business cannot advertise a sale within their business using this platform.

How to Apply

  1. No responsibility is accepted for incomplete, late, lost, delayed, or misdirected applications.

  2. In order to apply, applicants must:

    1. Register your Local Garage Sale: https://www.armadale.wa.gov.au/register-your-local-garage-sale;

    2. Accurately complete form in full;

    3. Read and agree to all terms and conditions; and

    4. Register your full name, email address and contact phone number

  3. At its sole discretion the CoA reserves the right to remove and exclude any participant from the Program at any time.

No Liability

  1. Any / all cost incurred by the participant associated with this Program are to be borne by the participant.

  2. All participants unconditionally and irrevocably indemnify, release and discharge the CoA and their associated personnel, agencies and companies from any and all liability, cost, loss or expense arising from participating in this Program including (but not limited to) loss of income, personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

  3. CoA and their associated personnel, agencies and companies will not be responsible or liable for:

    1. any loss or damage whatsoever or personal injury suffered or sustained, in connection with the Program, the sale, or any act or omission of CoA, or their respective agents, employees or contractors;

    2. any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access; or

    3. any inconvenience, loss or damage sustained or incurred:

      1. if, for any reason, the Program is suspended, varied or terminated at any time, with or without prior warning or publicity;

      2. as a result of late or incorrect applications;

      3. as a result of any change in the Program, or any element of the Program being incorrect.

  4. These indemnities and disclaimers apply to the full extent permitted by law.

Reserved Rights

  1. In all matters, all decisions of CoA will be final and cannot be contested. No correspondence or discussions will be entertained.

  2. Failure by CoA to enforce any of its rights at any stage does not constitute a waiver of those rights.

  3. The CoA reserves the right to amend these Terms and Conditions or cancel the Program at any time.

Privacy Details

  1. The CoA is collecting participants’ personal information for the purpose of conducting and promoting this Program. Upon application into this Program, CoA may collect applicants’ personal information, including name, address, age, telephone number and other contact details. CoA will not use this information for any purpose other than that outlined in these Terms and Conditions.

  2. Any personal information will be managed in accordance with CoA Privacy Statement. By providing personal information, each applicant agrees to the terms of CoA Privacy Statement. CoA Privacy Statement can be viewed at CoA website at https://www.armadale.wa.gov.au/privacy-statement

  3. By applying for this Program, each entrant acknowledges, agrees and expressly consents to CoA:

    1. contacting the applicant by any means to let the applicant know about goods, services, or promotions / competitions which CoA considers may be of interest to the entrant;

    2. disclosing the applicants personal information to other persons or applicants who may participate in the Program;

    3. through the program, discloses the date and time of their garage sale, the address of their garage sale, the items to be sold at their garage sale and any other information the City may deem necessary to promote the program without disclosing any personal information.

  4. Each applicant’s consent continues until the consent is withdrawn in accordance with the applicable law. Applicants have the option to withdraw their consent and unsubscribe from receiving any communications at any time.
